Terms of Use

These Terms of Use (“Terms”) govern the use of the iPhone / iPad app Site Reporter (the “App”) provided by Moeki Kozawa (“the Developer”). By downloading, installing, or using the App, you (“the User”) are deemed to have agreed to these Terms.

1. Scope

These Terms apply to every use of the App by the User.

2. License grant

The Developer grants the User a non-transferable, non-exclusive right to use the App for personal or business purposes in accordance with these Terms. The User may not transfer, lend, or redistribute the App to any third party.

3. Prohibited conduct

The User must not engage in any of the following while using the App:

  • Reverse-engineering, decompiling, disassembling, modifying, or creating derivative works of the App
  • Removing or altering copyright or trademark notices in the App
  • Removing or altering the “SAMPLE” watermark in generated PDFs by technical means without purchasing Pro
  • Any conduct that violates law or public order and morals
  • Any conduct that infringes the rights or interests of others (including photographing other people’s worksites, facilities, or persons without consent)
  • Any conduct that causes harm or damage to the Developer or any third party

4. User-registered content

Content the User registers in the App — project information, photos, comments, generated PDFs, etc. (“User Content”) — is the User’s responsibility. User Content is stored only on the User’s device and is not transmitted to the Developer’s servers.

If User Content includes anything subject to third-party rights (portrait rights, copyright, facility management rights, etc.), the User must obtain the necessary permissions independently.

5. In-App Purchase (Pro)

5.1 Pro features

The App offers a one-time-purchase Pro tier. Buying Pro removes the following restrictions:

  • Projects: 3 → unlimited
  • PDF watermark (“SAMPLE”): present → removed
  • Templates: 3 (Standard / Before-After / Inspection) → all 5 (Standard / Before-After / Inspection / Photo Album / Issue Summary)
  • Company logo embedding in PDFs: none → enabled (cover + page header)

The price is shown on the App’s in-app Pro screen via the App Store.

5.2 One-time purchase

Pro is a one-time purchase that grants lifetime access — there is no subscription. There are no automatic renewals or additional charges.

5.3 Restoring purchases

On any device signed in with the same Apple ID, the User can restore Pro free of charge by tapping the “Restore purchase” button on the Pro screen.

5.4 Refunds

Refunds for Pro follow Apple’s policy. Refund requests must be made through Apple Support at reportaproblem.apple.com. The Developer cannot process refunds individually.

5.5 Price changes

The Developer may change the Pro price as needed. Price changes apply only to future purchases and do not affect users who have already purchased Pro.

6. Intellectual property

All copyrights and other intellectual property rights in the App and in everything included with it (source code, design, text, images, trademarks, etc.) belong to the Developer or the respective rights holders.

Rights to User Content belong to the User.

7. Data handling

How data handled in the App is treated is governed separately by the Privacy Policy.

8. Disclaimer

8.1 As-is

The App is provided “as is”. No warranty of any kind — express or implied — is made regarding fitness for a particular purpose, merchantability, accuracy, completeness, or uninterrupted operation.

8.2 Business use

The App is a tool for assisting with site report creation. It does not guarantee the legal validity or official-document standing of any generated PDF. Whether a report’s content, fields, or format meets your organization’s internal rules or the laws and regulations of your industry (construction-business law, real-estate transaction laws, etc.) is your own responsibility to verify.

For legal judgments, please consult a lawyer or other qualified professional.

8.3 Data loss

Because data is stored only on your device, it may be lost due to device failure, loss, OS updates, or similar events. The Developer accepts no responsibility for damages resulting from data loss. For important projects, we recommend taking separate backups by exporting and sharing the PDF.

8.4 Limitation of liability

To the maximum extent permitted by applicable law, the Developer is not liable for any direct, indirect, incidental, or special damages arising from use or inability to use the App.

9. Service interruption and termination

The Developer may suspend or terminate the service, temporarily or permanently, without prior notice in the following cases:

  • For system maintenance
  • When service delivery becomes difficult due to force majeure (natural disaster, communication failure, etc.)
  • When the Developer chooses to discontinue the App

10. Changes to these Terms

The Developer may revise these Terms as needed. Significant changes will be announced on this page. Revised Terms take effect when they are posted here.

11. Governing law and jurisdiction

These Terms are construed under the laws of Japan. The Tokyo District Court is the exclusive court of first instance for any disputes related to the App or these Terms.
